Terms and Conditions of Sale
I. Definitions
The terms used in these Terms and Conditions shall mean:
1. Client – a natural person, a legal person, or an organizational unit without legal personality to which specific provisions grant legal capacity, who places an Order within the Store;
2. Civil Code – the Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended);
3. Terms and Conditions – these Terms and Conditions for the provision of electronic services within the online visit reservation website WIKINGCLUB.PL;
4. Reservation Website – the website available at www.wikingclub.pl, through which the Client may, in particular, make reservations;
5. Reservation – a service available on the website;
6. Sales Agreement – an agreement for the sale of a service within the meaning of the Civil Code, concluded between the sole proprietorship Dominik Kubat WIKING, NIP: 8992944747, with its registered office in Wrocław, 50-066, ul. Świdnicka 12-16, and the Client, concluded using the online service;
7. Act on Specific Conditions of Consumer Sales – the Act of 27 July 2002 on specific conditions of consumer sales and amendments to the Civil Code (Journal of Laws No. 141, item 1176, as amended);
8. Act on Providing Electronic Services – the Act of 18 July 2002 on providing electronic services (Journal of Laws No. 144, item 1204, as amended);
9. Order – the Client’s declaration of intent directly aimed at concluding a Sales Agreement, specifying in particular the type and number of services;
10. Administrator – the sole proprietorship Dominik Kubat WIKING, NIP: 8992944747, with its registered office in Wrocław, 50-066, ul. Świdnicka 12-16.
II. General Provisions
2.1. These Terms and Conditions define the rules for using the website available at www.wikingclub.pl.
2.2. These Terms and Conditions constitute the regulations referred to in Article 8 of the Act on Providing Electronic Services.
2.3. The website operating at www.wikingclub.pl is operated by Dominik Kubat WIKING, NIP: 8992944747, with its registered office in Wrocław, 50-066, ul. Świdnicka 12-16.
2.4. These Terms and Conditions define in particular [depending on available functionalities]:
a.) the rules for making reservations;
b.) the terms and conditions for making electronic reservations of services available on the website;
c.) the rules for concluding Sales Agreements using services provided within the website.
2.5. Use of the website www.wikingclub.pl is possible provided that the Client’s IT system meets the following minimum technical requirements:
a.) Internet Explorer in the current version as of the date of use, or
b.) Google Chrome in the current version as of the date of use.
2.6. In order to use the website, the Client should independently obtain access to a computer workstation or end device with Internet access.
2.7. In accordance with applicable law, Dominik Kubat WIKING, NIP: 8992944747, with its registered office in Wrocław, 50-066, ul. Świdnicka 12-16,
reserves the right to limit the provision of services via the online Store to persons who have reached the age of 18. In such a case, potential Clients will be informed accordingly.
2.8. Clients may access these Terms and Conditions at any time via a link posted on the homepage of the service www.wikingclub.pl, and may download and print them.
2.9. Information about services provided on the website, in particular their descriptions, duration parameters, and prices, constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
III. Rules for Using the Website
3.1. The website owner may deprive the Client of the right to use services provided at the premises located at ul. Świdnicka 12-16 in Wrocław, 50-066, with immediate effect, in the event of a breach of these Terms and Conditions by the Client, in particular if the Client:
a.) provided false, inaccurate, or outdated data during the purchase process on the website, misleading or infringing the rights of third parties,
b.) committed, via the website, an infringement of personal rights of third parties, in particular the personal rights of other website clients,
c.) engaged in other conduct deemed by the Administrator to be contrary to applicable law, general principles of Internet use, or harmful to the good name of the Administrator.
3.2. In order to ensure the security of communications and data transmission related to services provided within the Website, the website applies technical and organizational measures appropriate to the level of threat to service security, in particular measures to prevent unauthorized acquisition and modification of personal data transmitted over the Internet.
3.3. The Client is obliged in particular to:
a.) refrain from providing or transmitting content prohibited by law, e.g., content promoting violence, defamatory, or infringing personal rights and other rights of third parties,
b.) use the website in a manner that does not disrupt its operation, in particular through the use of specific software or devices,
c.) refrain from actions such as sending or posting unsolicited commercial information (spam) within the website,
d.) use the website in a manner that is not burdensome to other Clients or the Administrator,
e.) use all content posted on the website solely for personal use,
f.) use the website in compliance with Polish law, the provisions of these Terms and Conditions, and general principles of Internet use.
IV. Procedure for Concluding a Sales Agreement
4.1. In order to conclude a Sales Agreement via the website, the Client must visit www.wikingclub.pl, select a service, and perform successive technical actions based on messages displayed to the Client and information available on the website.
4.2. The selection of ordered services by the Client is made by adding them to the cart.
4.3. During the Order placement process – until the “Order” button is clicked – the Client may modify the entered data and selected services by following the messages displayed and information available on the website.
4.4. After the Client provides all necessary data, a summary of the placed Order will be displayed. The Order summary will include information regarding:
a.) the selected service,
b.) the unit and total price of the ordered services,
c.) the selected payment method,
d.) the selected service date,
e.) the place of service provision.
4.5. In order to submit the Order, the Client must accept the Terms and Conditions, provide the required personal data, and click the “Place order” button.
4.6. Submission of the Order by the Client constitutes a declaration of intent to conclude a Sales Agreement with the Administrator in accordance with these Terms and Conditions.
4.7. After placing the Order, the Client receives an email containing final confirmation of all essential elements of the Order.
4.8. The Agreement is deemed concluded upon receipt by the Client of the email referred to above.
4.9. The Sales Agreement is concluded in Polish and with content consistent with these Terms and Conditions.
V. Prices and Payment Methods
5.1. Service prices are given in Polish zloty and include all components, including VAT.
5.2. The Client may pay the price:
a.) by bank transfer to account number 06 1050 1142 1000 0097 7112 9229,
b.) via payment system PayPro S.A., ul. Pastelowa 8, 60-198 Poznań, NIP 779-236-98-87, REGON 301345068,
c.) by payment card via PayPro S.A., ul. Pastelowa 8, 60-198 Poznań, NIP 779-236-98-87, REGON 301345068.
5.3. The payment card operator is PayPro S.A. Settlement Agent, ul. Pastelowa 8, 60-198 Poznań, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań–Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register under KRS number 0000347935, NIP 7792369887, REGON 301345068.
VI. Right of Withdrawal
6.1. A Client who is a consumer within the meaning of Article 221 of the Civil Code has the statutory right to withdraw from a distance contract without stating reasons by submitting a written declaration within 7 days prior to the scheduled service date and sending it to the registered office address in Wrocław, 50-066, ul. Świdnicka 12-16 specified in these Terms and Conditions.
6.2. The 7-day period is counted up to the service performance date.
6.3. In the event of withdrawal from a distance contract, the contract is deemed not concluded. Any performances rendered by the parties shall be returned in an unchanged state, unless the change was necessary within the limits of ordinary management. The return should take place immediately, no later than within 14 days.
VII. Complaints Regarding Electronic Services
7.1. Dominik Kubat WIKING, NIP: 8992944747, with its registered office in Wrocław, 50-066, ul. Świdnicka 12-16, undertakes actions to ensure proper functioning of the Website to the extent resulting from current technical knowledge and commits to remedying any irregularities reported by Clients within a reasonable time.
7.2. The Client is obliged to immediately notify Dominik Kubat WIKING, NIP: 8992944747, with its registered office in Wrocław, 50-066, ul. Świdnicka 12-16, of any irregularities or interruptions in the functioning of the website.
7.3. Irregularities related to the functioning of the Website may be reported by the Client in writing to: Dominik Kubat WIKING, NIP: 8992944747, with its registered office in Wrocław, 50-066, ul. Świdnicka 12-16, by email at wikingaxethrowingclub@gmail.com or via the contact form.
7.4. In the complaint, the Client should provide their name and surname, correspondence address, and the type and date of the irregularity related to the functioning of the Website.
7.5. The website operator undertakes to consider each complaint within 14 days, and if this is not possible, to inform the Client within this period when the complaint will be considered.
8. Final Provisions
8.1. Any disputes arising between Dominik Kubat WIKING, NIP: 8992944747, with its registered office in Wrocław, 50-066, ul. Świdnicka 12-16, and a Client who is a consumer within the meaning of Article 221 of the Civil Code shall be submitted to courts having jurisdiction in accordance with the relevant provisions of the Code of Civil Procedure.
8.2. Any disputes arising between Dominik Kubat WIKING, NIP: 8992944747, with its registered office in Wrocław, 50-066, ul. Świdnicka 12-16, and a Client who is not a consumer within the meaning of Article 221 of the Civil Code shall be submitted to the court having jurisdiction over the registered office of Dominik Kubat WIKING.
8.3. In matters not regulated by these Terms and Conditions, the provisions of the Civil Code, the Act on Providing Electronic Services, and other relevant provisions of Polish law shall apply.
